FLINK Demo Platform Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the FLINK Demo Platform ("Demo Platform"). By accessing, registering, and/or using the Demo Platform, you ("User") agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Demo Platform.

1 DEMO PLATFORM NATURE AND PURPOSE

  • The Demo Platform is a sandbox, demo environment provided by FLINK Inc. ("FLINK," "we," "us," or "our"), a company incorporated in Wyoming, USA.
  • The Demo Platform is offered solely for demonstration, testing, and evaluation purposes, enabling Users to gain insight into FLINK's commercial offering.
  • No actual money, cryptocurrency, or assets of any monetary value may be used, transferred, earned, or withdrawn from the Demo Platform. All data and transaction records are purely simulated.
  • The Demo Platform does not constitute an offer to contract, to provide any services, or to form any binding obligations relating to commercial use.

2 USER CONDUCT

  • Users shall use the Demo Platform solely for its intended purpose of demonstration and evaluation.
  • The upload, purchase, viewing, or simulated resale of films are simulated actions for demonstration purposes only.
  • Users shall not:
    • Upload material which they do not own or hold the copyright to.
    • Attempt to bypass, hack, or otherwise interfere with the operation or security of the Demo Platform.
    • Use the Demo Platform for unlawful purposes or to conduct, promote, or facilitate illegal activities.
    • Use the Demo Platform in any way that could impair, damage, disable, or otherwise adversely affect FLINK's business, its technology, or the experience of other Users.

3 FAIR USAGE POLICY

  • The Demo Platform is provided free of charge for reasonable use. FLINK reserves the right to determine, in its sole discretion, what constitutes excessive or abusive use.
  • Excessive use of the Demo Platform (e.g., continuous, automated, or high-volume actions) may result in the suspension or termination of access, and/or the User being charged a fee for further usage as determined by FLINK.
  • FLINK will provide notice to the User in advance of any such charges.

4 DISCLAIMER OF WARRANTIES

  • The Demo Platform is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, either express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or performance.
  • FLINK specifically disclaims any responsibility for the accuracy, completeness, legality, or reliability of any content uploaded or any actions simulated within the Demo Platform.

5 NO LIABILITY

  • TO THE FULLEST EXTENT PERMITTED BY LAW, FLINK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, LOSSES, OR CLAIMS ARISING OUT OF OR RELATING TO YOUR USE (OR INABILITY TO USE) THE DEMO PLATFORM, EVEN IF FLINK HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF SUCH DAMAGES.
  • YOU ACKNOWLEDGE AND AGREE THAT ALL DATA, CONTENT, AND ACTIONS ON THE DEMO PLATFORM ARE SIMULATED, HAVE NO MONETARY VALUE, AND THAT YOU HAVE NO EXPECTATION OF PRIVACY, OWNERSHIP, OR COMPENSATION FOR ANY ACTIONS OR CONTENT ON THE DEMO PLATFORM.

6 INDEMNIFICATION

  • You agree to indemnify and hold harmless FLINK and its officers, directors, employees, agents, affiliates, and licensors against any and all claims, demands, losses, liability, damages, or expenses (including attorneys' fees) arising from your use or misuse of the Demo Platform, your breach of these Terms, or your violation of any third-party rights.

7 INTELLECTUAL PROPERTY

  • All rights, title, and interest in and to the Demo Platform, including but not limited to technology, software, design, and content (excluding User-uploaded films), are and shall remain the exclusive property of FLINK.

8 TERMINATION

  • FLINK reserves the right, at its sole discretion, to suspend, restrict, or terminate your access to the Demo Platform at any time without notice, for any reason, including but not limited to violation of these Terms or excessive use.

9 MODIFICATIONS

  • FLINK reserves the right to modify, amend, or update these Terms at any time by posting the revised Terms on the Demo Platform. Users are responsible for reviewing these Terms regularly. Continued use constitutes acceptance of any modifications.

10 GOVERNING LAW

  • These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Wyoming.
